Welcome to Lucy Gordon & Co Limited’s Terms and Conditions.

About us and these terms
1.1 lucygordon.com (our site) is operated by Lucy Gordon & Co Limited, a company registered in England under company number 16893261 whose registered office is at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ ("we", "us" or "our"). Our email address is [email protected].
1.2 These terms and conditions (Terms) apply when you buy any of the following from our site (each a Product):
- online courses, challenges and trainings (Courses);
- any add-on offered with a Course, including at checkout (Add-ons); and
- membership of our online coaching group (the Coaching Group).
1.3 These Terms do not apply to one-to-one coaching with Lucy Gordon, which is covered by a separate agreement.
1.4 Please read these Terms carefully before you buy. By placing an order, you agree to these Terms and that they take priority over any other terms, including your own terms of business. Please save or print a copy for your records.
1.5 These Terms should be read alongside our Privacy and Cookie Policy.
02
Your status
2.1 By placing an order, you confirm that:
- you are legally able to enter into binding contracts;
- you are at least 18 years old; and
- all information you give us is true and accurate.
2.2 Our Products are designed for business owners. If you are buying as a consumer (an individual buying wholly or mainly for purposes outside your trade, business, craft or profession), section 7 also applies to you.
03
How the contract is formed
3.1 Your order is an offer to buy a Product. After you place an order, you will receive an email acknowledging it. The contract between you and us (Contract) is formed when we send you an email confirming that you have access to the Product (the Access Confirmation).
3.2 Each Product you buy, including any Add-on bought at checkout or any further Product offered to you after checkout, is a separate Contract on these Terms.
3.3 We may refuse any order at our discretion and do not have to give a reason. If we do, we will refund any payment taken.
04
Prices and payment
4.1 The price of each Product is as shown on our site at the time you order, except in the case of an obvious error.
4.2 We sometimes offer a Product at a promotional price. Promotional prices may be for a limited time or limited to certain customers, and we may end or change them at any time. A change will not affect orders we have already confirmed.
4.3 We are not currently VAT registered, so no VAT is charged. If we become VAT registered, all prices shown on our site will include VAT unless our site clearly says otherwise.
4.4 All prices are one-off payments unless our site clearly says otherwise. Payment must be made in full at checkout using one of the methods shown on our site.
4.5 You will only be entitled to use a Product once we have received full payment for it.
05
Access to Courses and Add-ons
5.1 Your Course or Add-on will normally be made available automatically once your order is confirmed. If you have not received access within 24 hours, please email [email protected]. As our systems are automated, we will not be liable for any delay in access.
5.2 You will have access to a Course or Add-on for as long as we continue to offer it, and for at least 12 months from the date of purchase. If we stop offering a Course, we will give you at least 30 days' notice by email so you can finish it and download any materials you are allowed to keep.
5.3 To use our Courses you will need an internet connection and a device that can play video and open PDF documents.
5.4 Some Courses or Add-ons are delivered over a period of time. Where this applies, the timings will be shown on the sales page. Dates may change, and we will tell you of any change as soon as we reasonably can.
5.5 Your login details are personal to you. Please keep them confidential and do not share your access with anyone else.
06
The Coaching Group
6.1 The Coaching Group is an online community run in a private Facebook group. To join, you will need a Facebook account and must also follow Facebook's own terms.
6.2 Membership of the Coaching Group is a one-off payment. It gives you access to the group for as long as we continue to run it, and for at least 12 months from the date you join. If we decide to close the group after that, we will give members at least 30 days' notice by email.
6.3 What is included in the Coaching Group (for example live calls, question and answer sessions or content) is as described on the sales page at the time you join. We may change, add to or remove parts of what is included over time. If we can't attend a live session, we may move it. If you can't attend a live session, we will try to provide a replay but cannot guarantee one, and no refund is due for sessions you do not attend.
6.4 Group rules. To keep the group a useful and safe place for everyone, you agree to:
- be respectful to other members and to us;
- keep anything other members share in the group confidential and not share screenshots, recordings or details outside the group;
- not promote or sell your own products or services to other members, in the group or by private message, without our written permission; and
- not post anything unlawful, offensive or misleading.
6.5 We may remove posts and may suspend or remove any member who breaks these rules or these Terms. If we remove you for breaking the rules, no refund will be due.
6.6 We may record live sessions and share recordings with group members. By taking part, you agree that your image, voice and comments may appear in these recordings. If you would prefer not to appear, you can turn off your camera and use the chat instead.
6.7 Sharing wins. If you post wins, results or testimonials in the Coaching Group, or send them to us, you give Lucy Gordon & Co Limited permission to use, reproduce and share them (including as screenshots) in our marketing, with or without your name or likeness. If you would rather we didn’t, email [email protected] and we will stop using them in any new marketing.
6.8 We may refuse membership to anyone at our discretion and do not have to give a reason.
07
Your right to cancel if you are a consumer
7.1 If you are buying as a consumer, you normally have the right to cancel within 14 days of the Contract being formed by emailing [email protected] or using the form in the Annex. If you cancel in time, we will refund you within 14 days of being told.
7.2 However, our Courses and Add-ons are digital content that you can access straight away. By ticking the box at checkout, you ask us to give you immediate access and you agree that you lose your right to cancel once you have been given access.
7.3 For the Coaching Group, by ticking the box at checkout you ask us to start straight away. If you cancel within the 14 days, you agree to pay for the part of the service already provided, in proportion to the whole.
7.4 If you are not buying as a consumer, this section 7 does not apply.
08
Refunds
8.1 Because you get access to our Products straight away, we do not give refunds, except where section 7 applies or where the law requires it.
8.2 Any refund will be made using the same payment method you used to buy.
09
Intellectual property
9.1 We own (or are licensed to use) all intellectual property rights in our Products and everything in them, including videos, workbooks, templates, spreadsheets, worksheets, prompts and recordings (Materials).
9.2 We give you a personal, non-exclusive, non-transferable licence to use the Materials for your own business only. You may adapt templates and spreadsheets for use in your own business.
9.3 You may not copy, share, sell, publish, give away or otherwise make the Materials available to anyone else, or use them to create a competing product or to teach or coach others, without our written permission.
9.4 You may not record any part of our Products, including live sessions, without our written permission.
9.5 This section 9 continues after your Contract ends.
10
Training, not advice, and no guaranteed results
10.1 Our Products give general training and guidance. They are not financial, tax, legal, accounting or other professional advice and do not take account of your individual circumstances. You should take your own professional advice before making important decisions.
10.2 Your results depend on many things outside our control, including your business, your market and the effort you put in. We do not promise or guarantee any particular result, including any increase in income or reduction in working hours. Names such as "10x Challenge" describe the ambition of the exercise, not a promised outcome. Any examples of results, including our own and our clients', are not typical and do not mean you will get the same results.
10.3 We try to make sure the information in our Products is accurate and up to date, but we are not liable for any loss arising from it being inaccurate or out of date.
11
Our liability
11.1 If you are buying as a consumer, we will provide our Products with reasonable care and skill and they will be as described, of satisfactory quality and fit for purpose, as the law requires.
11.2 We are not liable for any loss of income, revenue, business, profits, contracts, anticipated savings, data or goodwill, waste of management or office time, or any indirect or consequential loss, however it arises.
11.3 Our total liability to you in connection with any Contract is limited to the price you paid for the Product concerned.
11.4 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your legal rights as a consumer.
12
Changes to our Products
We may update, improve or change the content, format, platform or timings of our Products from time to time. We will not make changes that take away the main benefit of a Product you have bought.
13
Events outside our control
We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including illness, technical failures of third-party platforms, or internet outages.
14
Communications and notices
14.1 You agree that we will communicate with you mainly by email. Notices to us should be sent to [email protected]. We may send notices to the email address you gave us when ordering.
14.2 An email notice is treated as received 24 hours after it is sent.
15
General
15.1 You may not transfer your rights under a Contract to anyone else without our written permission. We may transfer our rights and obligations at any time.
15.2 If we do not enforce any of these Terms straight away, we can still enforce them later. A waiver only applies if we confirm it in writing.
15.3 If any part of these Terms is found to be invalid or unenforceable, the rest will still apply.
15.4 These Terms, together with any document they refer to, are the whole agreement between us about each Product. You confirm you have not relied on anything said or written before your order except what is in these Terms or on the sales page.
15.5 Nobody other than you and us has any rights under these Terms.
15.6 We may change these Terms from time to time. The version in force when you place your order will apply to that order, unless a change is required by law.
16
Law and jurisdiction
These Terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
